Absolutely, a permit is needed to construct a below grade separate entrance to the basement. The specific requirements for below grade separate entrances can vary slightly from one municipality to another. 


A separate entrance is mandatory for your basement apartment to satisfy building code requirements. It should provide direct exterior access to the basement. 


Ontario Building Code:


(1) Except as provided in Sentences (2) and (3), every dwelling unit containing more than 1 storey shall have exits or egress doors located so that it shall not be necessary to travel up or down more than 1 storey ....... 


Absolutely. Engaging a structural engineer is necessary to create and authorize the plans with their stamp, ensuring compliance with building codes and safety standards. 


Below grade separate entrances must conform to building codes that outline design and construction standards. Our plans align with these codes, emphasizing safety and structural robustness. 


To construct a side below grade separate entrance, a minimum setback of 9 feet - 10 feet is required, with potential variations depending on the specific municipality. 


Below grade entrances are prohibited at the front of the house, but they can be constructed through the garage. The municipality stipulates that a property must have a two car garage (at minimum) to build a separate entrance through the garage.


Obtaining a separate entrance permit is a relatively quick process, typically taking around 3 - 4 weeks from the date of application submission. The duration may vary depending on the municipality. 


Depending on the location of the below grade separate entrance, the connection can be established with either the weeping tile or the sump pump. Regulations vary across cities, with some municipalities favoring weeping tile while others permit the use of a sump pump for drainage. 


You cannot have a below grade separate entrance if there is only 4 feet setback on the side of your house.
